Robert is a highly successful trial and appellate attorney

Robert has substantial experience representing clients in cases involving the Tort Immunity Act, professional liability (including dental malpractice and the defense of insurance producers), FELA, Consumer Fraud, Defamation, Breach of Contract, and Section 1983. He also represents Townships and Township Road Districts in claims for Declaratory Judgment and Injunctive Relief, primarily involving issues related to tax levies and separation of powers.

Robert’s expertise in defending public entities has afforded him the opportunity to speak to Township Officials of Illinois, Central District Highway Commissioners, and CCMSI Casualty Claims Adjusters on the Tort Immunity Act and PTELL.

Robert also has served as a Township Trustee which gives him a unique insight into the workings of a unit of local government. Robert remains active in the community, being elected to serve as a Park Commissioner for River Trails Park District in 2021 and serving as the manager of his daughter Emily’s softball team.

Experience

Robert has tried over 40 cases to a verdict, including the following:
A Not Guilty for a dentist who allegedly performed a failed full mouth restoration. Boneva v. Mechev
A Not Guilty for a Park District employee who rear-ended the plaintiff resulting in meniscus tears, a rotator cuff tear, and multiple disc protrusions. McVeen v. Hoffman Estates Park District

A Not Guilty in a Wrongful Death action as the result of a slip and fall on a public sidewalk from which Plaintiff sustained pelvic fractures and a pulmonary embolism. Estate of Martha Conn, deceased v. Village of Oak Park
A Not Guilty for a driver who rear-ended a vehicle allegedly causing a tear of the posterior horn of the medial meniscus. Skrypek v. Hines
A verdict $20,000 less than the offer in a case involving Plaintiff being repeatedly bitten in the face by Defendant’s 125 lb. Rottweiler resulting in permanent disfigurement. Michaelson v. Garibiane
A verdict for less than 35% of Plaintiff’s special damages in a FELA action in which the Plaintiff Metra conductor was attacked by a passenger and sustained distal tibia/fibula fractures and ruptured deltoid and collateral ligaments in the ankle resulting in a total ankle replacement. Smak v. Metra
Robert also has won appeals in the First, Second, and Third Districts, including the following:
A class action alleging that the Township illegally imposed a New Road Tax in violation of PTELL, which was dismissed for lack of jurisdiction. Reno v. Newport Township Road District
Summary Judgment was affirmed pursuant to 2-201 (Discretionary Immunity) and 3-108 (Supervision Immunity) of the Tort Immunity Act for a case involving Plaintiff falling in a construction site and sustaining a tibial plateau fracture. Smith v. Village of Oak Park
Summary Judgment was affirmed pursuant to the natural accumulation rule, 3-105 of the Tort Immunity Act (Weather Conditions Immunity), and the construction statute of repose in a case in which Plaintiff fell inside Peotone Junior High due to tracked in rainwater and required a hip replacement that resulted in an infection and months of rehabilitation.
