Is an Agenda required for closed session meetings?

Answer: No. The topics that can be discussed in closed session are limited to those specified in the Open Meetings Act. Those topics are generic, such as the employment or dismissal of "officers or employees" or "pending litigation." It is not necessary to publicly state in open session or in the motion to go into closed session which officers or employees or what pending litigation is being discussed. With regards to "litigation," the statutes require that the specific nature of the litigation be disclosed during the closed session and that the Minutes reflect the identity of the litigation as well as the officers and employees who are being discussed. If the entity goes into closed session with an intention of discussing the employment of a specific recreational supervisor, there is nothing to prevent the Board from discussing other specific officers or employees during that session. If there is some confusion about the order in which items will be discussed, the group can establish an agenda within the closed session. In the event that a Board member remembers that he or she also wanted to discuss the acquisition of a particular piece of property, the group can return to open session and make a motion to return to closed session to discuss this new topic. It is probably also acceptable to discuss the acquisition of land and, after returning to closed session, indicate to the public that another permissible subject was discussed in closed session.
